EL CONTROL DE REGULARIDAD REFLEJO

Resumen

El artículo analiza el concepto de control de regularidad reflejo dentro del sistema federal mexicano. Tradicionalmente, el control de regularidad se realiza de manera vertical, comparando normas locales con la Constitución o tratados internacionales para garantizar la protección de los derechos humanos.El autor propone ampliar este control hacia una dimensión horizontal, permitiendo comparar normas entre distintas entidades federativas para identificar cuál ofrece una mayor protección. Esta perspectiva, basada en el postpositivismo y el principio pro persona, busca maximizar la protección de los derechos humanos mediante la adopción del estándar más favorable, incluso si proviene de otra entidad.Se ejemplifica con la interrupción legal del embarazo, donde distintas entidades establecen plazos diferentes. Bajo el enfoque de control reflejo, debería aplicarse el plazo más amplio (como el de Sinaloa, 13 semanas) por ser el más protector, aunque la persona se encuentre en otra entidad.

Abstract

The article analyzes the concept of reflexive regularity control within the Mexican federal system. Traditionally, regularity control is carried out vertically, comparing local norms with the Constitution or international treaties to ensure the protection of human rights. The author proposes expanding this control to a horizontal dimension, allowing for the comparison of norms between different federal entities to identify which one offers greater protection. This perspective, based on post-positivism and the pro persona principle, seeks to maximize the protection of human rights by adopting the most favorable standard, even if it comes from another entity. It is exemplified by the legal interruption of pregnancy, where different entities establish different deadlines. Under the reflective control approach, the longest term (such as Sinaloa's, 13 weeks) should be applied as it is the most protective, even if the person is in another entity.
