Resumen

El artículo analiza cómo interactúan el bloque de constitucionalidad y el juicio de amparo contra normas generales a partir del principio pro persona, especialmente tras la reforma constitucional mexicana de 2011.Sostiene que la protección de los derechos humanos se fortalece mediante dos herramientas principales: la interpretación conforme (que busca armonizar normas para favorecer a la persona) y el control difuso de convencionalidad (que permite inaplicar normas contrarias a derechos humanos).El principio pro persona actúa como eje rector que obliga a elegir la norma o interpretación más favorable, integrando fuentes constitucionales e internacionales dentro del bloque de constitucionalidad.Asimismo, se explica que estas herramientas permiten superar limitaciones del juicio de amparo —como el principio de estricto derecho— ampliando la tutela judicial de los derechos fundamentales.Finalmente, el texto concluye que la combinación entre interpretación, control de convencionalidad y argumentación jurídica (armonización y ponderación) fortalece el sistema de protección de derechos humanos en México.

Abstract

The article analyzes how the block of constitutionality and the amparo trial interact against general norms based on the pro persona principle, especially after the Mexican constitutional reform of 2011. It argues that the protection of human rights is strengthened thru two main tools: the conforming interpretation (which seeks to harmonize norms to favor the individual) and the diffuse control of conventionality (which allows the non-application of norms contrary to human rights). The pro persona principle acts as a guiding axis that obliges the choice of the most favorable norm or interpretation, integrating constitutional and international sources within the block of constitutionality. Additionally, it explains that these tools allow overcoming limitations of the amparo trial—such as the principle of strict law—broadening the judicial protection of fundamental rights. Finally, the text concludes that the combination of interpretation, conventionality control, and legal argumentation (harmonization and weighting) strengthens the human rights protection system in Mexico.
