RETOS DE LA JUSTICIA ADMINISTRATIVA EN LA CDMX

Resumen

El artículo analiza la evolución y los desafíos de la justicia administrativa en la Ciudad de México. Destaca el tránsito de un modelo jurídico positivista hacia uno garantista, especialmente tras la reforma constitucional de 2011, que coloca a los derechos humanos como eje central del sistema jurídico.En este contexto, el Tribunal de Justicia Administrativa no solo debe verificar la legalidad de los actos de autoridad, sino también asegurar que respeten y protejan los derechos humanos, equilibrando estos con el interés público.El texto subraya que el Tribunal es clave para la gobernanza y la estabilidad social, ya que sus resoluciones buscan restablecer el orden jurídico y generar confianza en las instituciones.Finalmente, se identifican retos actuales como: acercar la justicia a la ciudadanía, mejorar su difusión y accesibilidad, modernizar los procesos mediante tecnología (especialmente tras la pandemia de COVID-19), y fortalecer la equidad de género en la impartición de justicia.

Abstract

The article analyzes the evolution and challenges of administrative justice in Mexico City. It highlights the shift from a positivist legal model to one based on the protection of rights, particularly following the 2011 constitutional reform, which places human rights at the center of the legal system. In this context, the Administrative Court of Justice must not only verify the legality of government actions but also ensure that they respect and protect human rights, balancing these with the public interest. The text emphasizes that the Court is key to governance and social stability, as its rulings seek to restore the legal order and build trust in institutions. Finally, current challenges are identified, such as: bringing justice closer to citizens, improving its dissemination and accessibility, modernizing processes through technology (especially in the wake of the COVID-19 pandemic), and strengthening gender equity in the administration of justice.
