Resumen

El artículo analiza el derecho humano a la educación y a la cultura en México como derechos fundamentales, irrenunciables y esenciales para el desarrollo individual y social. Señala que, aunque el Estado tiene la obligación constitucional de garantizarlos, el modelo económico neoliberal ha favorecido la educación privada, generando desigualdad, pobreza y limitaciones en el acceso educativo.Se destaca que la educación es un derecho social y colectivo, indispensable para el desarrollo de capacidades humanas y la construcción de una sociedad democrática. Asimismo, el Estado debe asegurar educación gratuita, universal y de calidad, asignando mayor presupuesto y supervisando su correcta aplicación.El texto también vincula la educación con el derecho a la cultura, entendidos como un binomio clave para el desarrollo científico, social y económico. Ambos derechos están respaldados por la Constitución y tratados internacionales, e implican garantizar el acceso a bienes culturales, la libertad creativa y la preservación del patrimonio.Finalmente, concluye que fortalecer la educación y la cultura es fundamental para enfrentar problemas como la desigualdad, la corrupción y la violencia, y para consolidar una sociedad libre, informada y participativa.

Abstract

The article analyzes the human right to education and culture in Mexico as fundamental, inalienable, and essential rights for individual and social development. It points out that, although the State has the constitutional obligation to guaranty them, the neoliberal economic model has favored private education, generating inequality, poverty, and limitations in educational access. It emphasizes that education is a social and collective right, indispensable for the development of human capacities and the construction of a democratic society. Likewise, the State must ensure free, universal, and quality education by allocating a larger budget and supervising its proper implementation. The text also links education with the right to culture, understood as a key binomial for scientific, social, and economic development. Both rights are supported by the Constitution and international treaties, and they involve ensuring access to cultural goods, creative freedom, and the preservation of heritage. Finally, it concludes that strengthening education and culture is essential to address issues such as inequality, corruption, and violence, and to consolidate a free, informed, and participatory society.
