PREVENCIÓN DEL DELITO, FACTORES QUE DEBEN IMPERAR #152-Francisco Xavier García Jiménez Resumen El artículo analiza la problemática de la inseguridad y el aumento de la delincuencia en la sociedad moderna, destacando que las políticas actuales de prevención del delito han sido insuficientes por no atender las causas reales del fenómeno. Se plantea que la prevención no debe limitarse al castigo, sino que debe abordarse desde un enfoque integral jurídico-social que incluya factores económicos, culturales y educativos.Se subraya la necesidad de una política criminológica moderna que combine acciones preventivas con la persecución del delito, fortaleciendo el Estado de Derecho y la participación ciudadana. Asimismo, se enfatiza que la prevención debe basarse en el análisis de factores de riesgo, el trabajo multidisciplinario y el fomento de valores sociales y jurídicos.Finalmente, se concluye que la prevención del delito es una tarea colectiva que requiere la colaboración entre instituciones, especialistas y sociedad para lograr una reducción efectiva de la criminalidad. It is proposed that prevention should not be limited to punishment, but should be approached from a comprehensive legal-social perspective that includes economic, cultural, and educational factors. The need for a modern criminological policy that combines preventive actions with the prosecution of crime, strengthening the rule of law and citizen participation, is emphasized. Likewise, it is emphasized that prevention should be based on the analysis of risk factors, multidisciplinary work, and the promotion of social and legal values. Finally, it is concluded that crime prevention is a collective task that requires collaboration between institutions, specialists, and society to achieve an effective reduction in criminality. JUICIO DE LESIVIDAD HERRAMIENTA LEGAL DE COOPERACIÓN ENTRE CIUDADANÍA Y AUTORIDADES #153-Estela Fuentes Jiménez Resumen El Juicio de Lesividad en México es un mecanismo del derecho administrativo mediante el cual una autoridad puede solicitar ante un tribunal la nulidad de una resolución previamente emitida por ella misma, cuando dicha resolución, aunque favorezca a un particular, resulte contraria al interés público o a la legalidad.Este juicio surge como una herramienta para garantizar el equilibrio entre la autoridad y los ciudadanos, evitando que la administración pública revoque unilateralmente sus actos y obligándola a someterse a un proceso judicial.A lo largo del tiempo, esta figura evolucionó de un ámbito exclusivamente fiscal a uno más amplio dentro del derecho administrativo. Actualmente, se rige por normas como el Código Fiscal de la Federación y la Ley Federal de Procedimiento Contencioso Administrativo, estableciendo que la autoridad tiene un plazo general de cinco años para promoverlo.El juicio protege la seguridad jurídica, ya que permite que un tribunal determine si el acto debe mantenerse o anularse, garantizando el derecho de defensa del particular y evitando abusos de poder. This trial arises as a tool to ensure balance between the authority and citizens, preventing the public administration from unilaterally revoking its acts and forcing it to submit to a judicial process. Over time, this figure has evolved from an exclusively fiscal scope to a broader one within administrative law. Currently, it is governed by regulations such as the Federal Tax Code and the Federal Law of Administrative Litigation Procedure, establishing that the authority has a general period of five years to promote it. The trial protects legal certainty, as it allows a court to determine whether the act should be upheld or annulled, guaranteeing the individual’s right to defense and preventing abuses of power. ANÁLISIS DEL ARTÍCULO 51, FRACCIÓN VIII, DE LA LEY DE AMPARO #153-Fernando Rangel Ramírez y Octavio Rosales Rivera Resumen El artículo analiza la fracción VIII del artículo 51 de la Ley de Amparo, que regula una causa de impedimento subjetiva para las personas juzgadoras. A diferencia de las fracciones I a VII, que establecen supuestos específicos y directos de falta de imparcialidad, la fracción VIII contempla situaciones no previstas expresamente, pero que pueden generar una duda razonable sobre la imparcialidad del juzgador.Se concluye que no es necesario probar una afectación real, sino que basta la existencia de elementos objetivos que impliquen un riesgo de parcialidad, incluso desde la perspectiva de un observador razonable. En estos casos, el juzgador debe plantear su excusa para que un órgano competente determine si debe apartarse del asunto.La norma busca proteger no solo la imparcialidad judicial, sino también el decoro, la confianza pública y la legitimidad del sistema de justicia, evitando cualquier sospecha de sesgo. Unlike fractions I to VII, which establish specific and direct assumptions of lack of impartiality, fraction VIII contemplates situations not expressly provided for, but which can generate a reasonable doubt about the impartiality of the judge. It is concluded that it is not necessary to prove a real affectation, but rather the existence of objective elements that imply a risk of partiality, even from the perspective of a reasonable observer. In these cases, the judge must present their recusal so that a competent body can determine whether they should withdraw from the matter. The rule seeks to protect not only judicial impartiality but also decorum, public trust, and the legitimacy of the justice system, avoiding any suspicion of bias. EL ARBITRAJE COMERCIAL INTERNACIONAL UN ALIADO DE LA JUDICATURA FEDERAL Y LOCAL EN MÉXICO #152-Edwin Nemesio Alvarez Roman Resumen El artículo analiza el papel del arbitraje comercial internacional en México como un mecanismo complementario al sistema judicial. Destaca que, a partir de la apertura económica en los años noventa y la adopción de la Ley Modelo de la CNUDMI, el arbitraje se consolidó como una herramienta eficaz para resolver controversias mercantiles, brindando seguridad jurídica, especialización y rapidez.En el contexto de recientes reformas judiciales y cambios en el sistema de justicia, el arbitraje adquiere mayor relevancia como un foro neutral que permite soluciones definitivas y ejecutables tanto a nivel nacional como internacional. El texto subraya la colaboración entre la judicatura y el arbitraje, basada en el respeto a la voluntad de las partes y en el reconocimiento del arbitraje como un mecanismo con protección constitucional.Asimismo, se analizan aspectos clave como los efectos del convenio arbitral, su posible extensión a terceros, la competencia de los árbitros, la nulidad del laudo y el concepto de orden público. Se concluye que el arbitraje no sustituye a los tribunales, sino que los complementa, contribuyendo a una justicia más eficiente, especializada y confiable. It highlights that, starting from the economic opening in the nineties and the adoption of the UNCITRAL Model Law, arbitration has consolidated as an effective tool for resolving commercial disputes, providing legal certainty, specialization, and speed. In the context of recent judicial reforms and changes in the justice system, arbitration gains greater relevance as a neutral forum that allows for definitive and enforceable solutions both nationally and internationally. The text emphasizes the collaboration between the judiciary and arbitration, based on respect for the parties’ will and the recognition of arbitration as a mechanism with constitutional protection. Additionally, key aspects such as the effects of the arbitration agreement, its possible extension to third parties, the competence of the arbitrators, the nullity of the award, and the concept of public order are analyzed. It is concluded that arbitration does not replace the courts, but rather complements them, contributing to a more efficient, specialized, and reliable justice system.
