LA NIÑEZ MIGRANTE EN MÉXICO #114-Ruth Villanueva Castilleja Resumen El artículo analiza la protección de la niñez migrante en México a partir del principio del Interés Superior de la Niñez, reconocido en instrumentos internacionales como la Convención sobre los Derechos del Niño. Este principio obliga a garantizar el pleno ejercicio de los derechos de niñas, niños y adolescentes, especialmente por su condición de vulnerabilidad.Se destaca la reforma a la Ley de Migración (2020), la cual transforma el enfoque de atención hacia la niñez migrante. LA IMPORTANCIA DE LA JUSTICIA ADMINISTRATIVA EN LA CIUDAD DE MÉXICO Y SU TRASCENDENCIA EN LA VIDA DE LAS PERSONAS #120-José Arturo de la Rosa Peña Resumen El artículo explica que la justicia administrativa es un mecanismo fundamental que permite a los ciudadanos defenderse frente a actos ilegales o arbitrarios de la administración pública. Su objetivo principal es garantizar el respeto al principio de legalidad, combatir la corrupción y asegurar el derecho a una buena administración.En la Ciudad de México, esta rama del derecho ha evolucionado históricamente desde el siglo XIX hasta consolidarse con la creación del Tribunal de Justicia Administrativa, órgano autónomo encargado de resolver conflictos entre particulares y autoridades. Its importance lies in the fact that it regulates many aspects of daily life, such as public services, permits, taxes, property, transportation, and social programs. Furthermore, administrative justice strengthens citizen participation, promotes oversight of public power, and enables citizens to hold the State accountable, including through mechanisms such as public actions and claims for property damage. JUICIOS ORALES MERCANTILES FEDERALES EN MÉXICO, UN RETO EN MARCHA #126-Paola Pons López Resumen El artículo analiza la implementación de los juicios orales mercantiles federales en México a partir de la reforma al Código de Comercio de 2011, destacando que su objetivo principal fue hacer la justicia más rápida, eficiente y accesible.Aunque en sus primeros años se observaron avances (como la reducción en tiempos procesales), el estudio señala que aún existen importantes retos para su consolidación, especialmente a nivel federal. Entre estos destacan la falta de infraestructura adecuada, insuficiencia de juzgados especializados, sobrecarga de trabajo, y una implementación parcial que ha derivado en un sistema mixto (oral-escrito).Asimismo, se identifica una débil aplicación de los medios alternativos de solución de conflictos (MASC), como la mediación y conciliación, debido a la falta de regulación clara, capacitación y cultura jurídica en su uso.El texto concluye que, si bien la oralidad representa un avance significativo, es necesario fortalecer la capacitación, infraestructura, regulación y promoción de mecanismos alternativos, así como fomentar un cambio cultural para lograr una justicia más efectiva y sostenible. Although progress was observed in the early years (such as a reduction in procedural timelines), the study notes that significant challenges to its consolidation remain, especially at the federal level. These include a lack of adequate infrastructure, an insufficient number of specialized courts, excessive caseloads, and partial implementation that has resulted in a hybrid system (oral-written). Furthermore, the study identifies weak use of alternative dispute resolution (ADR) methods, such as mediation and conciliation, due to a lack of clear regulations, training, and a legal culture that supports their use. The text concludes that, while oral proceedings represent a significant step forward, it is necessary to strengthen training, infrastructure, regulation, and the promotion of alternative mechanisms, as well as to foster a cultural shift to achieve a more effective and sustainable justice system. Señala que no basta con tener comprobantes fiscales ni registros contables, ya que estos por sí solos no demuestran la efectiva realización de las operaciones. Asimismo, advierte que incluso realizar operaciones reales no es suficiente si existe desorden documental o contable.Se enfatiza la necesidad de integrar un expediente completo que documente todo el proceso de la operación (desde su planeación hasta su conclusión), incluyendo contratos, cotizaciones, evidencia de ejecución y entrega de bienes o servicios. The article emphasizes the need to compile a complete file documenting the entire transaction process (from planning to completion), including contracts, quotes, and evidence of performance and delivery of goods or services. This enables the taxpayer to present solid evidence in the event of tax audits or litigation. Furthermore, it is noted that, in the event of disputes with the tax authority, the taxpayer may rely on presumptive, testimonial, and expert evidence, as well as on court rulings and principles such as good faith. The main challenge is to comprehensively demonstrate the economic reality of the transactions. Expone su origen histórico (desde el “agente provocador” en Francia), su evolución y su reconocimiento en instrumentos internacionales como la Convención de Palermo.Define al agente encubierto como un funcionario policial que, con autorización legal, se infiltra en organizaciones criminales ocultando su identidad para obtener información y pruebas. Su objetivo principal no es provocar delitos, sino descubrir conductas delictivas preexistentes.El texto aborda su regulación en México, particularmente en el Código Nacional de Procedimientos Penales, así como su aplicación en el derecho comparado (Colombia, Chile y España). Their primary objective is not to provoke crimes, but to uncover preexisting criminal conduct. The text addresses the regulation of undercover agents in Mexico, particularly in the National Code of Criminal Procedure, as well as their application in comparative law (Colombia, Chile, and Spain). It also outlines the requirements for their operations, such as judicial or ministerial authorization, the prohibition against inducing criminal conduct, and respect for the principle of proportionality. It discusses the risk of impunity when an undercover agent commits criminal acts during their infiltration, acts that are justified under theories such as the “non-enforceability of alternative conduct.” Furthermore, the paper links the use of undercover agents to the so-called “enemy criminal law,” highlighting the tension between effectiveness in prosecuting crime and respect for fundamental rights. EL MEDIO AMBIENTE Y LOS DERECHOS HUMANOS SU CONCEPCIÓN CONSTITUCIONAL #122-Alejandro Tadeo Villanueva Armenta Resumen El artículo analiza la relación entre el medio ambiente y los derechos humanos desde una perspectiva constitucional en México. Plantea que el derecho a un medio ambiente sano es un derecho humano fundamental, derivado del derecho natural y reconocido en la Constitución. Sin embargo, critica la ineficacia del marco jurídico actual debido a deficiencias en la técnica legislativa, el exceso de reformas y la influencia de intereses políticos y económicos.El autor sostiene que el Derecho Ecológico debe entenderse de manera interdisciplinaria, no solo como regulación de recursos, sino como una forma de reorganizar la relación del ser humano con la naturaleza. Asimismo, destaca la necesidad de garantizar mecanismos efectivos (garantías) para hacer exigibles estos derechos.Finalmente, propone que la vida debe considerarse como principio general del derecho, ya que, sin condiciones ambientales adecuadas, los demás derechos pierden sentido. Concluye que la crisis ambiental refleja fallas estructurales del sistema jurídico y requiere una transformación profunda en la concepción del derecho y del papel del Estado. It argues that the right to a healthy environment is a fundamental human right, derived from natural law and recognized in the Constitution. However, it criticizes the ineffectiveness of the current legal framework due to deficiencies in legislative technique, excessive reforms, and the influence of political and economic interests. The author argues that environmental law must be understood in an interdisciplinary manner—not merely as the regulation of resources, but as a means of reorganizing the relationship between humans and nature. Furthermore, he emphasizes the need to ensure effective mechanisms (guarantees) to enforce these rights. Finally, he proposes that life should be considered a general principle of law, since, without adequate environmental conditions, other rights lose their meaning. He concludes that the environmental crisis reflects structural flaws in the legal system and requires a profound transformation in the conception of law and the role of the State.
